These Terms of Service (“Terms”) govern your access to and use of the INTAKEPULSE platform and website at intakepulse.com, operated by Andrew Crosley, doing business as IntakePulse (“INTAKEPULSE,” “we,” “us,” or “our”). By creating an account or using the platform, you agree to these Terms.

The Service

INTAKEPULSE provides an AI-powered intake and case-management platform for law firms, including call transcription, lead qualification, case narratives, and follow-up task and reminder tracking. Where a firm enables it, the platform can also support the firm in sending follow-up communications to its own leads and clients. We may update, change, or discontinue features from time to time.

Accounts and Eligibility

The platform is intended for use by law firms and their authorized staff. You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 18 years old and able to enter into these Terms.

Customer Responsibilities for Messaging

If you use the platform to send text messages or emails, you are the sender of those messages and you are responsible for complying with all applicable laws and carrier requirements, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, CTIA messaging guidelines, and carrier A2P 10DLC registration requirements. In particular, you agree that you will:

Obtain clear, prior consent (opt-in) from each recipient before sending text messages, and maintain records of that consent.
Only send messages that relate to the recipient’s matter or that they have agreed to receive.
Honor opt-out requests promptly, including replies of STOP, END, CANCEL, UNSUBSCRIBE, or QUIT, and provide HELP (or INFO) information on request.
Accurately identify yourself (your firm) as the sender in your messages.
Authorize INTAKEPULSE to act as your messaging service provider, including registering your brand and campaign for A2P 10DLC on your behalf, and provide accurate, current information for that registration.

Acceptable Use

You agree not to use the platform to:

Send unsolicited messages (spam) or messages to recipients who have not consented or who have opted out.
Send content related to SHAFT categories (sex, hate, alcohol, firearms, or tobacco), or other content prohibited by carrier or CTIA guidelines.
Send unlawful, fraudulent, deceptive, harassing, defamatory, or misleading content, including phishing or links to malicious sites.
Violate the privacy or intellectual-property rights of others, or share another party’s data without authorization.
Attempt to disrupt, reverse-engineer, gain unauthorized access to, or circumvent the security of the platform.

We may suspend or terminate access for violations of this Acceptable Use section.

Intellectual Property

We retain all rights in the platform and our software. You retain all rights in the data you submit. You grant us a limited license to process that data solely to provide the platform.

Confidentiality and Data

Our handling of personal information is described in our Privacy Policy. You are responsible for ensuring you have the right to provide any data you submit to the platform.

Disclaimers

The platform is provided “as is” without warranties of any kind. INTAKEPULSE does not provide legal advice, and AI-generated output may contain errors and should be reviewed by a qualified professional before use.

Limitation of Liability

To the maximum extent permitted by law, INTAKEPULSE will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the platform.

Termination

You may stop using the platform at any time. We may suspend or terminate access if you breach these Terms or to protect the platform or its users.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
